　　家住扬州的张同学在湖南上大学，8月初，他从湖南托运一台电脑回扬州，快递公司给了小张一快递货单，上面写明收件人、地址、联系电话、保险额度等基本内容，并告知张同学货到付钱，快递服务费用为95元。可是几天之后，张同学到扬州提货，扬州一快递公司却要求其支付215元。 
　　双方产生分歧，张同学向市物价部门举报求助。经调查得知，该起价格纠纷与我市快递公司无关。湖南快递公司为招揽生意，故意向张同学隐瞒了真实价格。事实上，张同学的电脑从湖南运回扬州的途中还经过了武汉、常州等地，需收多项中转费。而这些中转费全部由扬州这家快递公司承担，所以张同学应该支付扬州该家快递公司215元。 
　　也就是说，张同学和扬州快递公司都被湖南那家快递公司给“忽悠”了。鉴于小张的学生身份，且事先并不知情。在市物价局的调解下，最终张同学向扬州快递公司支付了105元（加收10元搬运费）。

　　日前，市民李小姐来到青岛市四方工商分局重庆南路工商所申诉称，8月2日，她委托一家有长期合作关系的快递公司，将价值180元的韩国泡菜三天内送达远天天快递在泉州的朋友，并一再强调所送食品易变质，务必如期送到，快递公司承诺使命必达。
　　三天后，李小姐打电话问泉州的朋友是否已享用美味泡菜，其朋友称尚未见泡菜踪影，十天后，朋友发来“泡菜刚刚收到，但已严重变质”的短信。李小姐立马找快递公司理论，自知理亏的快递公司开始答应赔偿李小姐货款180元、速递费45元，但后来又提出泡菜不值180元，无法提供购物发票的李小姐与快递公司由此产生纠纷。
　　工商部门调查认为，李小姐是托运人，韵达公司是承运人。根据《合同法》规定承运人应当在约定期间将货物安全运输到约定地点。当事人一方履行合同义务不符合约定，给对方造成损失的，应该承担损失赔偿责任。快递公司运输超过了约定的时间导致了食物变质应该赔偿李小姐货物损失和运费损失。如果双方约定了圆通违约金，快递公司还应当依据《合同法》支付与李小姐约定的违约金。除非快递公司能证明货物的毁损、灭失是因不可抗力、货物本身的自然性质或者合理损耗以及托运人、收货人的过错造成的天天快递，才能不承担损害赔偿责任。
　　李小姐委托天天快递公司所送的韩国泡菜市值180元左右，经调解双方最终达成一致，快递公司赔偿李小姐货款180元、运费45元，并表示道歉。

    据介绍，《快递业务员国家职业标准》将快递业务员分为初级工、中级工、 
高级工、业务师（技师）和高级业务师（高级技师）五个等级，分别从职业功能、工作内容、技能要求和需要掌握的相关知识等方面作出了明确的界定，为快递业务员的技能发展打开了成长天天快递的通道。 
    该标准的颁布，填补了我国邮政业国家职业标准的空白，为推动邮政业建立国家职业资格证书制度、培养建设技能型人才队伍奠定了良好的基础。 
    国家邮政局有关负责人指出，《快递业务员国家职业标准》将成为对快递业务员进行鉴定和考核的唯一依据。目前，与《快递业务员国家职业标准》相配套的教材、题库、操作考核大纲的编写建设工作已经启动。近期，国家邮政局正在全国有重点地选择部分省（市）邮天天快递政管理局作为试点，组建机构，开展职业技能鉴定工作。快递业务员初级工的职业技能鉴定工作将在明年初展开。 
    据了解，早在２００７年５月，国家邮政局就开始启动“申通快递业务员国家职业标准”课题。《快递业务员国家职业标准》的制定历经数十次的论证、修订和召开座谈会广泛征求意见，先后通过了初审和终审，并于今年７月完成了最终的报批稿。

　　8月6日，许女士与大连中通快递公司丁某取得联系，对方答复：“时间太久了，记不得具体情况了，大概是送到并有人签收了。”许女士表示自己及同办公室的同事都没有签收快件。至记者发稿时，许女士也没有收到快递公司的答复，圆通投递员也没有提供出已签收货物的单据。 
　　如今，要急送一件物品，肯定会想到快递公司；现在，许多人都会网上购物，而这也需要快递公司送货物。不过，快递的质量如何呢？面对100多家快递公司到底如何选择？记者了解到，随着四大跨国快递巨头齐聚大连，国企、民企和外企各展所长抢占市场，大连的快递市场竞争空前激烈。      
　　A 记者调查快递市场陷入“乱战”      
　　记者通过近期对大连市快递市场采访了解，大连市快递运输行业发展十分迅速，目前全市快递企业近百家，中外运敦豪、TNT快运、联邦快递、联合包裹等四大国际知名快递巨头相继登陆，嘉里大通、中铁快运等国内快递企业也天天快递纷纷布局大连。同时，一些夫妻店、作坊式的，结构松散，：快递查询组织混乱的小快递公司也加入市场“分食”份额。 
　　一位较大型快递公司老总告诉记者，现在不少人看到快递业有利可图，便纷纷成立快递公司，但办公场所其实只有一张桌子、一部电话，一个业务员，甚至可能连营业执照也没有。为了抢夺市场，他们纷纷压低市场价格，使得，韵达快递业处于无序竞争状态。“他们的交通工具是自行车，稍远的送达地点，对他们来说是个挑战。”不过他也坦言，这几年，该公司受到小快递公司的价格冲击不小。     
　　B 规范市场行业性规定正在酝酿      
　　交通运输部的《快递市场管理办法》已于2008年7月8日经第8次部务会议通过，并予7月29日公布，自公布之日起施行。该《办法》是我国专门天天快递规范快递市场的第一部行政立法性文件，标志着快递行业将实行市场准入制度。大连市道路运输管理处和大连市快递行业委员会也组织20多家快递公司成立统一的自律协会，以此为契机，规范和整顿全市快递行业经营秩序，引导天天快递快递企业向集约化、规模化方向健康发展，维护广大消费者的合法权益。 
　　据介绍，市道路运输管理处已把全市快递行业纳入行业管理，并积极支持成立市快递专业委员会，把行业监管和行业自律结合起来。在此基础上，为提高快递行业服务质量，我市正在酝酿出台《大连市快递企业自律公约》、《大连市快递企业经营服务公约》等多个行业性规定，用以规范引导全市快递行业有序发展和竞争。

]]> http://www.02951.com/blog/u/1059/archives/2008/owusqwrnlj.html uxptmt4136 2008-12-12 15:50:00 通过申通快递从绍兴寄一块电板到杭州换修，当时说好24小时内送到。祝先生原本的计划天天快递是：快递查询16日到达杭州后，当日由杭州方将新电板寄出，17日他就可以拿到新电板了，然后前往台州参加摄影比赛。可是直到16日下午，快件还没到杭州换修处。祝先生有点着急，打电话催促申通快递。谁知对方的回答是：快件送错地方，去了萧山。祝先生当即表示，不管用什么办法，16日下午5点前一定要把快件送到杭州。申通快递却回复“只能在17日送达”。
　　结果一直到8月18日，祝先生的快件才到杭州。而此时，他已经在台州参加摄影比赛了。由于电板没有及时换来，祝先生不得不花150元钱买了一块新电板。他为此感到十分不满，要求申通快递赔偿他的损失并返还快递费。
　　记者随后联系了天天快递的有关人员，对方表示，祝先生快件所在的这批货物，确实由于网络问题而错发到了萧山。他们公司也尽力补救过，但第二天正好碰到双休日，杭州方面部分地区的快递人员不工作，所以只能等到周一才将祝先生的快件发出。申通快递方面还表示，如果快件丢失天天快递，他们可以依据公司有关规定赔偿。现在祝先生的快件没有丢失而仅是延期，他们不能对物件进行赔偿。该负责人指出，双方当初的快递条约中没有明确规定延期应承担的责任，因此最大限度只能向消费者返还5元快递费。
　　对此，市消保委有关人士认为，快递公司的做法如果是依据其公司规定，那么该规定有“霸王条款”的嫌疑，否则，应考虑其做法的合法性及合理性。
　　那么，快件迟到造成的损失如何赔偿？记者就此向中圣律师事务所的何百坤律师作了咨询。何律师表示，新的合同法出台后，要求合同方在订立合同时，天天快递要对违约赔偿有预见性。也就是说，消费者要在寄快件时，向快递公司说明时间要求及重要程度，不能等到出了事才告知物品的重要性或紧急性。在事先告知重要性的情况下，由于快件迟到造成的损失，若快递公司有明确承诺到达时间的，那么消费者可以向快递公司要求对损失加以赔偿。因此，消费者在签订快递协议时应注意以上几点。
